SMALL CLAIMS APPEAL
Sometimes the Small Claims process can be unfair. No lawyers are allowed. Just you versus the other party. The matter is heard by a Judge Pro Tem or Commissioner. Quite often not enough time is allowed and you end up with "rough" justice. If you were the defendant on the wrong end of a money judgment, you have the right to appeal the judgment. You have a limited period of time to request a "Trial De Novo." The court filing fee for the appeal is $75 made payable to the Court Clerk. If you were the Plaintiff, and you lost, there is no appeal of an adverse judgment.

Unlike the Small Claims proceeding, the Trial De Novo is heard by a real Superior Court Judge. Either side may have an attorney represent them at the hearing. There is no appeal from the ruling at the end of the Trial De Novo. Generally, neither Party will be aware, until the day of the hearing, whether the plaintiff or defendant will have an attorney on their side. If you are a plaintiff who won a judgment only to have the defendant request a Trial De Novo, or a defendant trying to reverse an unfair judgment, having an attorney by your side may be what it takes to achieve the result you desire.
