Civil litigation generally includes all disputes that are formally submitted to a court, about any subject in which one party is claimed to have committed a wrong, but not a crime. In practice and in ordinary conversation, lawyers and others concerned with civil litigation tend to treat many specialized subjects as outside this definition, such as labor law, as well as divorce actions and even small claims cases, even though all of these are technically types of "civil" litigation. I handle personal injury claims, general civil litigation, and landlord/tenant issues.

Personal Injury claims, such as auto accidents, dog bites, trip & falls, are generally handled on what is known as a "contingency fee basis," meaning that the attorney is paid a percentage of the recovery by means of settlement or award.

Other types of civil litigation are usually handled on an "up front" retainer fee, whether as a "flat" fee or an advance against an hourly rate. Such cases include litigation over contracts, business disputes,and the like. Hourly fees and flat rate retainers are negotiable and depend on the type of case, it's complexity and the amount of time expected to reach a final conclusion of the matter.

Landlord/Tenant disputes, generally involving most commonly what is known as the Unlawful Detainer (i.e. the landlord seeks to remove the tenant for non-payment of rent). These also are handled on either a mutually agreed flat fee or hourly retainer depending on the complexity of the matter.
